Terms of Service

Please read these Terms before using Swift Warning. By downloading, installing, accessing, or using the App, API, or website, you agree to these Terms. If you do not agree, do not use the Services.

1. Agreement

Swift Warning is an app by Jag Journey, LLC. These Terms of Service ("Terms") are a contract between you and Jag Journey, LLC ("Company," "we," "us," or "our"). They cover the Swift Warning application (also known as SW App, and previously True Instant Fire Alerts / Fire Alerts), swiftwarning.com, and related APIs (the "Services").

Our Privacy Policy is part of this agreement. The Privacy Policy explains SMS, Telnyx, and other providers.

2. What the Services are (and are not)

Swift Warning provides wildfire and related safety information: dispatch-based new starts, maps, saved-location alerts, air quality, and similar layers drawn from public and licensed feeds.

The Services are informational only. They are not an official government warning system, not a substitute for 911, and not a guarantee that any alert will arrive in time. Always follow local fire departments, law enforcement, and official evacuation orders. Conditions change in minutes. Feeds can be late, incomplete, or wrong.

3. SMS and phone numbers

Account sign-in uses SMS one-time codes sent by our provider Telnyx to the mobile number you submit.

We do not sell your number. We do not send third-party marketing texts.

4. Accounts

You must provide an accurate mobile number and keep your device secure. You are responsible for activity on your account. We may suspend or close accounts that violate these Terms, abuse SMS, spoof incidents, or threaten the service, with or without notice.

The API at swiftwarning.com/api (and the legacy fireapp host) is for the official App and our own systems. You may not access it from unauthorized apps, exceed rate limits, cache it for redistribution, or reverse engineer it. We may suspend API access immediately if we believe these rules were broken. Data from the API stays owned by Jag Journey, LLC and/or the originating agencies. You get a limited license for personal, non-commercial use inside the App.

7. Premium, stores, and ads

V1 is free. If Premium or Family is later sold in the Apple App Store or Google Play, those stores handle payment and refunds under their rules. Web premium, if launched, goes through Pay by Jag. We do not put a card form on this website today. Subscriptions that auto-renew follow the store or Pay by Jag terms you accept at checkout.

The free App may show Google AdMob ads. Premium, when offered, may remove ads.

8. Intellectual property

The Swift Warning name, SW App short name, site, App, and our original content are owned by Jag Journey, LLC. Agency data remains theirs. You may not copy, sell, or lease the Services without written permission. "Swift" as used here is our product name for a warning service. It is not Apple's Swift programming language, the SWIFT banking network, or any other company's Swift product.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." We do not warrant that alerts will be complete, accurate, timely, or delivered. We do not warrant uninterrupted or error-free operation. Fire and weather change quickly. Use official channels as well.

10. Limitation of liability

To the maximum extent allowed by law, Jag Journey, LLC is not liable for indirect, incidental, special, consequential, or punitive damages, including personal injury, property loss, or damages from relying on an alert that was late, missing, or wrong. Our total liability will not exceed the amount you paid us in the twelve months before the claim, or $100, whichever is greater. Some states do not allow certain limits. In those states our liability is limited to the fullest extent permitted.

11. Indemnity

You will defend and indemnify Jag Journey, LLC and its officers, employees, and agents against claims arising from your use of the Services, your SMS number, your content, or your breach of these Terms.

12. Changes, law, and disputes

We may change these Terms. We will update the date on this page. Continued use is acceptance.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Disputes will be resolved by binding individual arbitration under American Arbitration Association rules, except either party may seek injunctive relief in court. You waive class actions and class arbitration.

If a section is unenforceable, the rest stays in force. Failure to enforce a section is not a waiver. You may not assign these Terms. We may assign them. We are not liable for failures caused by events beyond our reasonable control, including carrier or provider outages.
